AT&T has not updated the whitelist of unlocked phones and quite some time. If you already own the phone you can check the IMEI

If you are considering purchasing the phone, just make sure you buy the US or North American version which should work with talk text and data. It likely will not be compatible with 5G or Wi-Fi calling.

If it is an AT&T phone then the built-in features would not be restricted. But if you bought an unlocked phone from somewhere else, it is not up to the seller if capabilities might be limited or purposefully restricted on a carrier it was not built for.
Neither of that is fraud. Just sounds like you should do more research before purchasing a phone, especially if not from the carrier you plan to use it with.
