ATT Account Manager committed Fraud and deceived me

On Tuesday May 16th I had a technician come out to check my Internet 2GPS which was running slow for a long time. He found that a wire was not connected and fixed it. One hour later a Account Manager named Sagar came to my house to see if my issue was solved. He then asked about my wireless service which was with Verizon. He told me that i could get a better service with ATT. I had 2 phones paid for and unlocked I always purchase from Samsung every year. My phone was a s23 Ultra unlocked paid for the other was a s22Ultra also paid for an unlocked. He then explained that if I switch i get a free S23 Ultra for free. He  came back on Thursday May 18th with a new s23 Ultra and took my S22. He also told me I would not be in a contract. I had problems with the phones not working and he told me I have a 2 week grace period to decide and he would fix the issue. On Tuesday May 23rd I received a bill from ATT for 327$ and found out that I was in a 36 month contract with a locked phone. I called him and send him a text. His answer was after the  first billing cycle the phone would be mine and ATT would unlock it in the same text he mentioned customer service always talks big and they do not take care of customers as they should. On Wednesday May 24th I texted him about My grace period and he answered that i am well within the 2 weeks and can cancel and he can come to bring s22 Ultra back and I can leave ATT any time I want as long as I call him. So I texted him to please come bring i back and I cancel ATT. I received his message that he will come back the next day to take care of it. On May25th he did not come his phone was not working anymore and I was suddenly stuck. This is when my dilemma started. I called customer service and they told me to wait 3 billing cycles. I did but nothing happened. I called customer service a lot over the next 2 month and recorded the conversations. Several service agents researched the issue and admitted that what Sagar did was fraud and that the gentleman no longer works for ATT. I escalated the issue until today but ATT admitted I was right but they told me the statue of limitations run out and they will not let me out of that contract unless I pay 750$. I have contacted a consumer attorney and the statue of limitations is 4 years in Texas so they all are lying to me. I have tried everything possible to no avail. Another huge issue is that I have an unlimited plan but ATT throttles me after 2GB and it is impossible to get to the Internet when both phones switch to 5G. They dont even work in an ATT store.. This is totally unbelievable. The only option I have left Is filing a complain with the FCC and the BBB. I have everything in writing and recorded conversations. I can not believe a billion dollar company treats their clients that way. I also happened to be an ATT shareholder.

File the complaint.  FCC or BBB doesn’t matter as they follow the same path.  Filing both doesn’t do anything extra.  The alphabet agency forwards the complaint to upper management, and a representative from the Office of the President will contact you in a couple of days for resolution.

AT&T will contact you and explain to you what you agreed to, which would indeed be a phone that is free after 36 months of installments, and bill credits equaling the installments. Bill credits may not start the first month. Your first month service would include installments, would not yet include your auto-pay and paperless billing discount, would not yet include your discounts for having both wireless and internet
